From 2027
Four changes take effect. One new standard emerges.
From 2027, the risk profile for larger UK employers changes materially. A wider group of employees comes into scope sooner, the financial consequences of unfair dismissal increase, and sensitive workplace decisions become harder to defend without a clear evidential record.
Six-month qualifying period
Ordinary unfair dismissal protection reduces from two years to six months. Employees hired from late June 2026 onwards will be in scope from the first day of the new regime.
Compensation cap removed
The removal of the statutory cap on unfair dismissal awards increases the potential cost of weak process, incomplete documentation and inconsistent decision-making.
Fire-and-rehire restrictions
Dismissal linked to refusal of certain contractual changes becomes significantly more sensitive, creating greater exposure where process and evidence are lacking.
Zero-hours and related obligations
Additional obligations around guaranteed hours, cancelled shifts and wider workplace compliance expectations increase the need for structured, defensible records.
